If you wish to become a customer or active user of our Webshop, please read our Terms and Conditions carefully and only use our services if you agree to be bound by all sections of it.

These General Terms and Conditions (hereinafter GTC) contain the rights and obligations of Eszkimó Kitchen Kft. (hereinafter “Service Provider”) and the Customer (hereinafter “Customer”) using the electronic commerce services provided by the Service Provider through the website www.eszkimokonyha.hu (The Service Provider and the Customer together are the “Parties”). The GTC applies to all legal transactions and services made through the www.eszkimokonyha.hu website.

The Customer's acceptance of the GTC, including the Delivery Contract and Privacy Statement, happens simultaneously with the registration on the website or, in case of unregistered guest purchases, with the placing of the order. The amendment of the GTC does not affect the contracts already concluded. The Service Provider notifies the Customer of any changes to the GTC upon entering the web interface. If the Customer does not accept the modifications, no order can be placed through the web interface.
Purpose of the General Terms and Conditions
These General Terms and Conditions contain the terms and conditions of purchases (including the operation of the Webshop, orders and their fulfilment) conducted through the www.eszkimokonyha.hu Internet shop ("Webshop") operated by Eszkimó Kitchen Kft. (the Service Provider) and the rights of the Customer.
Through the Webshop, the parties enter into a contract for the individual sale of products. Each contract of sale is concluded for a definite period by acquiring ownership of the products ordered by the Customer (buyer), not including deadlines for the Customer's claims arising out of the Service Provider's failed, late or defective fulfilment or breach of contract.
The contract can be concluded in Hungarian. The placing of an order is deemed to be a contract concluded electronically in accordance with the provisions of Act No. CVIII of 2001 on certain aspects of electronic commerce and information society services (Act on E-Commerce). The contract is subject to Government Decree 45/2014 on the detailed rules of contracts concluded between consumers and businesses and takes into account the provisions of Directive 2011/83 / EU of the European Parliament and of the Council on consumer rights.
The contract is concluded upon receipt of the automatic confirmation.
1.3. Filing of the contract: A contract made through the website is not a written contract, it is not filed by the Service Provider, nor is it subsequently accessible.
1.4 The General Terms and Conditions were predetermined unilaterally by the Service Provider and were not negotiated by the parties.
1.5 The services of www.eszkimokonyha.hu are available to all users after registration
1.6. Once the order has been placed, the contract may be modified or cancelled without any consequence until its fulfilment. This can be done via phone and e-mail. The contract concluded between the Parties for the purchase of goods in Hungarian language is deemed to be a written contract, is filed by the Service Provider, is retained for 5 years after its conclusion, and is accessible afterwards.

The Service Provider mainly sells additive-free sausages, bacon and other smoked goods in the course of its business activities on the website.
The Service Provider does not abide by any code of conduct regarding the services it provides.
2.1 The products shown may be ordered online with home delivery.
2.2 The Webshop offers products with detailed product information on the subpages. We strive to provide the broadest and most accurate information about the given product in the description of the products sold by the store.
2.3 In the case of images displayed next to the products, we strive to accurately represent the product, but in some cases the image may be considered as an illustration only and may differ slightly from reality. These differences do not exceed the level which would constitute the illustration of a different product.
2.4 The product displays contain the following information: product name, order unit, price (gross), photo, other properties, product information.
3.1 The prices quoted are the retail prices, inclusive of all taxes and contributions, and are in all cases valid at the time of the launch of the product. The Service Provider sells the ordered product at consumer price valid at the time of the order.
3.2 After placing the order, the system sends an automatic confirmation e-mail, and the Service Provider undertakes a price guarantee for the prices stated therein; i.e. the invoice will be issued for the prices of the ordered products irrespective of the price changes after the placing of the order.
3.3 If the Service Provider, despite all due diligence, displays a faulty price on the website, in particular with regard to prices which are significantly different from the obvious or widely accepted or estimated prices, or prices due to system error marked as -0 or -1 HUF, the product cannot be purchased at the given price; however, the Service Provider is entitled to offer the sale at the correct price.
3.4 The discount on promotional items and promotional packages is always based on the normal price on the day the promotion starts.
How to Order
4.1 Registration is required for the use of the website and for purchases. The quick registration can be done on the homepage of the website.
Only one registration can be done per e-mail address. When you submit your registration, our system will send a confirmation e-mail to the e-mail address you provided containing the registration validation information. This is to avoid false registrations. Registration is validated by clicking on the link in the confirmation e-mail or by copying and opening the link in the web browser.
Shipping and billing information is not included in the registration and must be provided at the time of purchase.
5. How to Buy Online
5.1 Enter your username and password in the login window and log in.
5.2 Specify the quantity you want to purchase on the product data sheet and click the [Add to Cart] button to add the product to the so-called virtual cart.
5.3 You can continue shopping or select the "Check out" button if you do not wish to purchase additional products.
5.4 Proceed as described in point 1 for each product you wish to purchase.
5.5 You can delete products in your cart. You can view or change the contents of your cart throughout the order process. If the cart does not contain the quantity you want to order, you can delete and re-order it in the right quantity.
5.6 Click the [Check out] button on the cart interface to proceed with the order.
5.7 You will then be required to provide a shipping and billing address

5.10 Prior to placing an order, the Customer must read and accept the Terms and Conditions and acknowledge the payment obligations associated with the order.
5.11 As the final step in placing an order, click the [Submit Order] button to send your order to us.
5.12 You will receive an automatic confirmation of your order via email, which will include all the order details. The order can be modified via phone by referring to the order number.

7.3 The costs to the Customer associated with the sale are (1) the purchase price of the product and (2) the shipping and handling costs. The Service Provider does not charge any other costs or fees to the Customer.
7.4 The costs of communication between distant parties (electronic data connection, telephone call charges) is always borne by the party who incurs the costs.

8.1 If you have any complaints about your purchase, please feel free to contact us at the contact details provided on the website (e-mail, phone number) regarding your complaint.
8.2 The Customer is entitled to a warranty under the applicable legal provisions. According to the warranty law, the Customer is not obliged to take the defective product and is obliged to notify the Service Provider and the Delivery Provider within the shortest possible time after the discovery of the defect. Return the ordered product by mail or delivery service to our company address. Be informed that the cost of returning the product is borne by the Customer, parcels sent by cash-on-delivery post cannot be received by our company!
8.3 In our Webshop we sell perishable foods with a shelf life identical with the expiration date of the product. The shelf life of foodstuffs is only valid if the purchased product is unopened and intact. Customers should always follow the manufacturer's storage instructions, especially regarding the temperature and use of the product after opening the package.
8.4: Shelf life: The shelf life of the product is indicated on the packaging.
9.1 According to Government Decree 45/2014. (II. 26.), the customer is not entitled to the right of withdrawal, as the object of the service is perishable food or a product preserving its quality for a short period of time or in a sealed packaging which, for health or hygiene reasons, cannot be returned after opening.
9.2 General information on the right of withdrawal or cancellation: According to Government Decree No. 45/2014 (II. 26.), the Customer has the right to cancel the purchase without justification within 14 days after the receipt of the goods. In this case the Service Provider must refund the full amount paid by the Customer, including the delivery cost, immediately, but no later than 14 days after the receipt of the Customer's notice of withdrawal or cancellation. If the Company fails to comply with its obligation to provide information, the period of withdrawal or cancellation is to be extended by 12 months. If the Company provides the information after 14 days but within 12 months of the receipt of the product or of the conclusion of the contract, the period for withdrawal or cancellation is 14 days from the date of such communication.
Procedure for exercising the right of withdrawal:

9.3. Upon receipt of the package to our company, the returned product will be inspected. If the package is packed properly and is intact, the product will be replaced, or our company will refund the purchase price to the bank account specified by the Customer within thirty days.
The Customer exercises their right of withdrawal within the time limit if he/she sends his/her notice of withdrawal before the 14th day after receipt of the product. In the case of a written withdrawal, it is enough to send the notice of withdrawal within 14 days. In case of postal delivery, the date of posting, in case of notification by e-mail or fax, the time of sending the e-mail or fax will be considered.
In case of cancellation the Customer is obliged to return the ordered product to the address of the Service Provider without delay, but not later than within 14 days from date of the notice of cancellation. The deadline is met if you send the product before the 14-day deadline (so it does not have to arrive within 14 days). The Customer bears the cost of returning the goods as a result of exercising the right of withdrawal. The Customer is not charged any other costs. However, the Service Provider is not obliged to refund the additional costs incurred by choosing a mode of delivery other than the cheapest option offered by the Service Provider. The Service Provider is entitled to withhold the refund of the total amount paid by the Customer until the product is returned or the Customer has credibly verified that he/she has returned it.
The Service Provider will use a payment method identical to the payment method used in the original transaction for the refund, unless the Customer expressly consents to the use of another payment method; the customer will not be charged any additional costs due to the use of this refund method. The Customer is only liable for any depreciation resulting from use beyond the use necessary to determine the nature, characteristics and performance of the product.
The Customer bears the responsibility of proving that the right of withdrawal is exercised according to Government Decree 45/2014. (II. 26.).
In case of the purchase of several products, if the delivery of each product takes place at different times, the Customer may exercise the right of withdrawal within 14 days from the last delivery or receipt of the last product or item in case of multiple products.
The Customer continues to exercise his/her right of withdrawal between the date of conclusion of the contract and the date of receipt of the product;

Exceptions to the customer's right of withdrawal and cancellation:
According to Government Decree 45/2014. (II. 26.) § 29 (1), the customer may not exercise his/her right of withdrawal in the following cases:
(c) in the case of a non-pre-prepared product which has been manufactured at the instruction of or at the specific request of the Customer or which was clearly tailored to the expectations of the Customer;
(d) perishable or short-lived products;
(e) product in sealed packaging which for health or hygiene reasons cannot be returned after it has been opened;
(f) in the case of a product which, by its nature, is inextricably mixed with another product after its delivery;
10. Complaints and Legal Disputes
10.1 In the event of a complaint, you may contact us using the contact details provided in these Terms and Conditions. Complaints received will be promptly investigated and, if necessary, remedied and records will be kept.
10.2 The record of the complaint must contain:
(a) the Customer's name and address,
(b) the place, time and way the complaint was lodged;
(c) a detailed description of the Customer's complaint, a list of the documents and other evidence which the Customer has submitted;
(d) a statement by the business regarding its position on the Customer's complaint, where an immediate investigation of the complaint is possible;
(e) the signature of the person taking the record and, except in the case of oral communication via telephone or other electronic communications service, the Customer’s signature;
(f) the place and date of the record
(g) in the case of oral complaints via telephone or other electronic communications service, the unique identifier of the complaint. A copy of the record is provided to the Customer promptly and in a verifiable way.

The Hungarian Authority for Consumer Protection (HACP)
The European Commission has created a website where customers can register, allowing them to have their online shopping disputes to be settled through this platform by completing an application, thus avoiding court proceedings. By doing so, customers can enforce their rights without, for example, being prevented by distance. Hungary is also obliged to operate an online dispute resolution contact point, where a minimum of two counsellors must be available to assist the parties in dispute if they have questions regarding the procedure.

11. Privacy Statement
We hereby inform you that your data will be stored for the purpose of fulfilment of the contract and subsequently proving the terms of the contract.
Your data will not be passed on to third parties, unless the third party (e.g., a transport company) is acting as a subcontractor to our company at the time of the fulfilment of the contract. However, in this case, the subcontractors are in no way entitled to retain, use or transfer any personal information provided by us.
While browsing the Webshop, technical information is logged (for example, in the form of log files containing the user's IP address, as well as the time and URL of the page you visit), which is not personally identifiable but is used for statistical purposes or to recommend additional products. The system also stores data on the user's computer in the form of “cookies”. Cookies are not personally identifiable and remain in use for 180 days after or during use.

When handling your data, we comply with Act CXIX of 1995 on name and address data management for the purpose of research and direct marketing. We will act in accordance with the provisions of the Law on the Management of Name and Address for Research and Direct Business Purposes.
Please be informed that by registering and ordering as a Customer, you agree that your personal data (name, address, telephone number, e-mail, purchase data) will be stored, handled and used for shipping activities and sending of purchase offers by Eszkimó Kitchen Kft. in compliance with the provisions of the relevant data protection laws.
The controller must provide the information in writing at the request of the person concerned, in a comprehensible form within the shortest possible time, but not more than 25 days from the submission of the request. The information is free of charge. If there is a change to your personal data, please let us know by modifying your registration.
You can request the deletion of your information from our customer service via mail or e-mail.

12.1. The Webshop and its contents are protected by copyright, and the Service Provider is exclusively entitled to exercise these proprietary rights.
12.2. The Service Provider reserves all rights with respect to the Webshop, its parts and the content (including images, text, documents) contained here. It is prohibited to download, electronically store, process and sell the content or any part displayed on the Webshop without the prior written consent of the Service Provider.
13.1. These Terms and Conditions are effective as of March 1, 2018 and will remain in effect until modified or revoked.
13.2. The Service Provider is entitled to unilaterally change the General Terms and Conditions. The Service Provider publishes the link to the amendments of the General Terms and Conditions on its website (on the Webshop website) before their entry into force.
14. Miscellaneous Provisions
14.1. These General Terms and Conditions contain primarily the terms and conditions of the contract between the Customer (a natural person acting in his or her profession, self-employment or business) and the Service Provider. If the Customer is not a customer in the above sense, then the provisions of these Terms and Conditions relating to customers do not apply.
14.2. The Service Provider is entitled to use a contributor to fulfil its obligation. The Service Provider is responsible for the contributor’s unlawful conduct as its own conduct.
14.3. Should any part of these Terms and Conditions become invalid, illegal or unenforceable, the validity, legality and enforceability of the remaining parts will not be affected.
14.4. Failure by the Service Provider to exercise its right under these Terms and Conditions does not constitute a waiver of such right. The waiver of any right is subject to specifically written notice to that effect. The fact that the Service Provider does not strictly adhere to any material terms or conditions of the Terms and Conditions on one occasion does not mean that it waives any obligation to adhere to such terms or conditions at a later date. There is no code of conduct under the Act on the prohibition of unfair commercial practices against consumers.
14.5. All trademarks and terminology appearing in these Terms and Conditions are the exclusive property of their proprietors.
